Lennar Homes Unpaid Overtime Investigation
McGillivary Steele Elkin LLP is representing a number of individuals in actions against Lennar Homes for its failure to pay overtime to Construction Managers in violation of the Fair Labor Standards Act and state laws.
If you worked for Lennar Homes at any time in the last three years as a Construction Manager and worked more than 40 hours per work week but were not paid overtime, you may have a claim for unpaid overtime, liquidated damages, and/or interest and attorneys’ fees and costs.
Under the Fair Labor Standards Act, a job title does not matter. Even if you are a “Construction Manager” paid a salary, you may still be entitled to overtime pay if:
- You spent most of your time performing manual labor or hands on construction work;
- You have no authority to hire or fire employees;
- You do not supervise other employees;
- You must follow stringent corporate policies in performing your work with little to no decision-making authority; and/or
- You do not exercise independent judgment with respect to matters of significance to the Company.
MSE has years of experience handing claims for unpaid overtime, recovering millions of dollars on behalf of workers nationwide, including workers who have been misclassified as ineligible for overtime by their employers.
